How are bans against *** marriage Constitutional?

emoandcleancut asked:

The only argument against *** marriage is based on the Bible. Take religion out of the discussion and it’s basically a Civil Rights issue. Aren’t *** marriage bans a violation of the First Amendment? Why hasn’t this been argued in court yet?

i don’t understand why there isn’t at least a way to have ALL the legal benefits of a marriage. i can why see churches can’t be forced to marry *** people, but they should have the option.

Because they aren’t banning *** marriage – what they are doing to get around it is “legally defining how the state classifies marriage” – and legally stating it is between a man and a woman. It isn’t “banning” *** marriage, but defining the marriage unit.

Personally, I believe that “marriage” is a church term and ceremony, and the law has no place in defining it. A “civil union” is a legal union, and has nothing to do with a church or religion. That should be open to whomever decides to go through the process – whether they be a man and a woman, or two men or women. The law has no place dictating the bible or morals.

It constantly is argued in court. But when states started defining marriage as opposed to stating that gays can’t marry, that is how they got around it.

    marriage

i’ve never figured that out. the gov’t is prohibiting certain members of the population from enjoying a right that every other member of the population does. i think that’s the very definition of descrimination. yet somehow it’s been passed in almost every state in the union. i think it’s a travesty of justice.

This is why several states have enacted Constitutional Amendments to restrict Civil Unions and *** Marriages. There has been some talk of enacting a Federal Constitutional Amendment that will ban *** Marriage.

Because of freedom of religion. *** marraige is against Christianity. Don’t you usually get married by a Priest or a Rabbi? Unless your aithiest or not of Christian religion, most people would refuse to marry a *** couple. Even though the first amendment is freedom of speech, that’s only what it says. Your free to have *** and do what you want but speaking and marrige is differnt. America was based on the belief of God and God doesnt believe in *** marrige or *** relationships. So it’s basiclly unethical in America to be *** and married.

That is why it is constitutional, once you take God out of the discussion then it is unconstitutional. There are many courts that has God out of system and this is how they can uphold these laws. Laws like these should and will be abolish.
