How can I petition my minor children to US, I have acquired a green card through marriage to a US Citizen?

I filed a divorce in US for my previous marriage in the Philippines. I am now married to a US Citizen and I want to petition my children who are below 12. What are the procedures and how long does it normally take.

Does my ex-husband needs to sign a consent that our children can migrate to US?

    I do not know the answers, but can tell you where to start – look up the US immigration website regarding the procedure. You will need to look up Phillippines law about taking them out of that country – and i would assume that you do need their father’s consent.

    Have your American husband file an I-130 for each of them. There is no quota and so they should be here in less than a year. Philippine law will be the determining factor as to what it takes to get them out of the country. I suggest you consult with a Family Law Attorney in the Philippines.

    you said your children are minor. Yes your husband consent is needed once they are approved to be with you in US.
    Minor children travelling without their parents are needed to secure clearance also from DSWD. need some more info, visit the forum that will help you a lot. visajourney.com
