Is it legal to relinquish your parental rights for a child acquired through marriage?

Rhonda F asked:

A friend of the family is separated from his wife due to infidelity, spousal abuse and a number of other vindictive behaviors. Against his better judgement he adopted her five year old adopted child. She just recently filed for child support against him, knowing full well that he is currently paying child support ( $900 a month) for his birth children from a previous marriage. She promised to drop the child support order if he agrees to reconcile their relationship. He is currently in arrears of about $13,000. What can he do?

Sorry to tell you but your friends will have to pay the child support for the child unless he reconciles with her. I’m sorry it is a very terrible situation to be in.

An adopted child is treated the same as a biological child. If this woman is so terrible, your friend should file for full custody of the child and let Mom be the one paying support.
