What is the exact amendment that was passed allowing same *** marriage?
DanceItUp asked:
I seem to be having a hard time finding the exact ammendment that was passed in California allowing same *** marriage. I was able to find parts of it on websites quoting it as saying marriage is between “any two persons” rather than between a man and a woman. But I’d like to see the whole thing, the exact wording. In case I’m not making sense I’d like to see the amendment that Prop 8 overturned. Thank you.

marriage
You won’t find one because there was no amendment overturned. The CA Supreme Court consolidated six separate marriage-related cases together and ruled on them all at once, but Supreme Court decisions do not create constitutional amendments.
I’ve linked the text of the majority decision which Prop 8 overturned.

there was no amendment. It was a court decision from four judges in the California Supreme court, who interpreted the law to say that you could not deny a person marriage because it was a ” right” The state of california as a whole voted to repeal that decision and define marriage as only between a man and a woman within the Constitution, now it is law, and even liberal judges must obey the law. .

No ammendment was overturned. What was overturned was the ruling by activist Judges that were prodded by the agenda of a special interest group.
Judges are not legislators. They are to make sure that laws are obeyed, but, they are not in their positions to shortcut or short circuit the legislative system.
The people of CA have spoken. We now have an ammendment to our State constitution which clearly delineates what we already knew. That by definition, a marriage is between a man and a woman.
In the words of a San Francisco Mayor.. “Like it or not..” Well, “like it or not”, Prop 8 passed, and I for one am glad.
It’s not because I have a particular dislike for homosexuals, it’s because I don’t like forced acceptance of an arguably deviant sexual lifestyle, and I really don’t like to have the definition of marriage changed from what it has been clearly understood to be for thousands of years.
